Regulations and General Conditions
All our Group Tours comply with the General Travel Conditions. Other travel packages, cruises and international trips comply with the general conditions specified in their own programmes. The CONTRACTING PARTY is aware that the CONTRACTED PARTY simply acts as an intermediary operator in the contracting of national and international tourist services, which is why, within the limits of its attributions, it complies with the principles of the Consumer Defence Code and the Resolutions of the MTUR (Ministry of Tourism).
Price:for the purchase of the aforementioned services, the CONTRACTED PARTY will receive from the CONTRACTING PARTY the amount specified in the "Purchase Summary" and "Payment Method" in this document. Late payment of instalments will be increased by 10% fine and 2% interest per month. After 5 days from the due date, they will be included in the credit protection agencies and 10 days will be sent for protest. The CONTRACTING PARTY is aware and agrees that for the condition of payment in instalments, the credit will only be granted upon approval of the registration, as well as declaring their awareness and agreement with the assignment of credits and/or the transfer of endorsed securities, as a result of the financing obtained to carry out the trip contracted herein, in accordance with the provisions of articles 286, 287 and 290 of Law 10.406/2002 (Civil Code). The default of any payment instalments will be subject to the usual collection process and will allow the CONTRACTED PARTY to cancel the confirmed services, before or after the start of the trip, without any liability for compensation or reimbursement of the services used. The price paid for the trip includes only the services and fees described herein, and the CONTRACTING PARTY is solely responsible for any others that are not included herein.
Specific Conditions of the Operator:the CONTRACTED PARTY acts as an intermediary between its clients and service providers, declining responsibility for any and all problems, losses or damages, resulting from acts of God or force majeure, such as strikes, disturbances, quarantines; natural phenomena: earthquakes, hurricanes, floods, avalanches, modifications, delays and/or cancellations of air routes due to technical, mechanical and/or meteorological reasons, over which the Operator has no power of prediction or control. For technical-operational reasons, the CONTRACTED PARTY reserves the right to make any necessary changes to itineraries, hotels, services, etc. If necessary, it may also change the departure date in order to guarantee transport, limiting these changes to one day more or less than the original date, informing the client of the change and giving them the option of accepting or cancelling their booking with a refund.
Local Tours/Excursions:local tours confirmed by the CONTRACTED PARTY will be subject to reconfirmation by the local operator up to 05 days before the trip. In the event of cancellation of the tour by the local operator, the CONTRACTED PARTY will offer a similar itinerary, with dates close to the contracted tour. The CONTRACTED PARTY reserves the right to cancel any and all trips where the number of passengers does not reach the minimum required to complete the entire programme. In this case, it is at the passenger's discretion to opt for a full refund of the contracted amount, choose another destination or change the date, according to the options offered. The difference in value must be paid in accordance with the payment terms stated in the new programme.
Specific conditions for land, sea and river bookings:the booking request must be made in writing and accompanied by the initial deposit of 30 per cent of the package per passenger (booking deposit). In the case of last minute bookings, i.e. those made up to 10 (ten) days before departure from the city of origin, the initial deposit will be at least 50% of the value of the trip programme, and a non-refundable communication fee will also be charged. Full payment must be made immediately after confirmation of the services requested. Failure to complete payment will allow the CONTRACTED PARTY to cancel the confirmed services, in accordance with the clauses in item 6. If the purchase of any CONTRACTED PARTY product is made through a Travel Agency or Promoter that fails to comply with the payments agreed with the Operator on their respective due dates, the confirmed services will also be cancelled. In the event of this happening, it will be up to the injured consumers to claim compensation from the defaulting Travel Agency or Promoter who sold them the product, exempting this Operator from any liability, even on a residual basis. Prices will be maintained upon full payment. Otherwise, the prices may change as a result of exchange rate variations and/or government resolutions that demonstrably alter them.
Change requests:requests for changes will result in a penalty being applied to the passenger under the contracts signed by the CONTRACTED PARTY on their behalf.
Presentation for boarding cruises, airports and train stations: must strictly follow the times indicated on the vouchers/tickets, under penalty of forfeiting the transport and the amounts paid.
Accommodationcheck-in at the flats and/or cabins starts between 2pm and 4pm and check-out between 10am and 12pm. The double room may or may not have separate beds. The triple or quadruple flat can be made up of articulated bed or sofa bedreducing the internal space of the flats.
Meal Regimethe breakfast served in most hotels (when included in the programme) is generally a continental breakfast (coffee, milk, tea, butter and toast), unless otherwise specified.
Tourstransfers: these can be private or regular tourist services, shared with other passengers, and are carried out in a vehicle of a size proportional to the number of people.
The driver will remain at the hotel entrance until 15 minutes after the time specified in the travel itinerary. If the passenger has any problems or is more than 15 minutes late, the service will not be carried out and there will be no refund.
Luggagethe passenger's luggage and other personal items are not the subject of this contractthese travel at the passenger's own risk. The CONTRACTED PARTY shall not be liable for any loss, theft, loss or damage to luggage during the journey, for whatever reason, including handling during transfers, where this service exists. In the event of damage or loss, the passenger must lodge a complaint with the transport company at the time, and it is advisable to take out insurance before starting the journey. On transfers and land excursions, passengers will be entitled to carry one piece of luggage weighing up to 23kg, in addition to hand luggage on valuables: the CONTRACTED PARTY is not responsible for theft of documents, valuables or personal belongings during the journey. It is advisable to check with the hotel to see if there are safes for these. Insurance companies in Brazil only offer insurance for loss of luggage when it has been transported somewhere by air to/from Brazil, so they do not offer insurance in the event of loss in taxis or transfers, hotel halls or hotel rooms.
The CONTRACTED PARTY does not recommend taking valuables with you when travelling, and if necessary it is advisable to carry them in your hand luggage. If you choose to leave valuables in the hotel safe, check the cover offered in the event of the safe being broken into. The CONTRACTED PARTY also advises never to leave suitcases outside the room, in the hotel corridor, even when a local operator requests this. If a suitcase is left in the corridor, neither the hotel, the local operator nor the CONTRACTED PARTY will be held responsible for it.
Optionsin our brochures and website, we indicate optional tours, visits and restaurants. These are not included in our products, they are merely suggestions and we are not responsible for their operationalisation or quality.
No Showno-show: Failure to board on the date and time of the trip, without any justification (no-show), or if the CONTRACTOR abandons the trip before the scheduled end date, will be charged a fine equivalent to the full amount paid for the package, which is used to cover all the costs and operating expenses of the trip, paid in advance by the CONTRACTED PARTY. For local tours/excursions, the CONTRACTING PARTY agrees that it should consult the specific conditions with each local service provider.
Specific Cancellation Conditions:cancellation is understood to mean giving up the trip and/or the contracted service, as well as changing dates. Requests for cancellation of the trip or contracted services must be made in writing to operacional@vivenciasoperadora.com.br and penalties will be applied according to the advance notice and criteria with which they are communicated, due to the advance notice with which such services need to be contracted and paid for with the respective suppliers by the CONTRACTED PARTY:
Up to 90 days before the start of the trip: communication costs plus cancellation costs for air, rail and sea tickets, if any of these have already been issued.
From 89 to 30 days before the start of the trip: 25 per cent of the total contract price.
From 29 to 10 days before the start of the trip: 50% of the total contract price.
Less than 10 days before the start of the trip: 100% of the total contract price.
**Important: train tickets and sea and river transport such as ferries, hydrofoils, ferries and others are not refundable. It will be possible to replace the passenger with another, provided that the same regime and type of accommodation remains and that it happens within the period previously informed, with the possibility of a fee being charged by the suppliers.
Documents to be Provided by the Contractorthe contractor undertakes to send all the booking confirmations mentioned in this contract via the system, provided that the contractor has paid for the booking in full.
Documentation for which the Contractor is responsiblepersonal documentation such as ID cards issued by the Public Security Department with an issue date of less than 10 (TEN) years, passports valid for at least 6 (six) months from the date of return from the trip, visas, vaccinations, etc. are the sole responsibility of the passenger. Therefore, the impossibility of boarding due to lack of documentation will result in cancellation of the trip and the penalties mentioned in the "Specific Cancellation Conditions" will be applied.
Insurancethe contracted package includes Basic Assistance Insurance, issued by a regulated insurance company, for passengers up to 85 years of age, according to the information provided with the boarding documents.
Complaints: In the event of complaints regarding the provision of services, the client must submit them in writing to the CONTRACTED PARTY within 30 days of the end of the services, in accordance with Article 26, Item I, paragraph 1 of the Consumer Defence Code. If this is not done within the stipulated period, the contractual relationship will be considered perfect and finished.
Understanding the Conditions of the Chosen Programmethe Contractor, Travel Agency or Promoter declare that they have read and understood the terms of the specific conditions relating to the programme purchased and agree with the clauses mentioned in this contract.
